Presentation

Our Confidentiality and Personal Data Protection Charter details how we collect, use and protect information relating to the Art Action website and digital services. It applies to all Internet users and users who have access to the site and the services derived from it. Art Action acts as data controller for the purposes of the legislation and regulations applicable to data protection in the Principality (Law No. 1.165 on the protection of personal information); as well as Regulation (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data (the “GDPR”).

Information collected by us

Depending on the services offered by the website you are using, and the choices and configuration retained on your device (in particular with regard to cookies), the personal data concerning you (your “current data”), collected and processed by Art Action mainly include: your names, date of birth, e-mail address, postal address, telephone number, preferences and interests as well as in the event of your purchase of products and services, your billing and transaction details , records of your connections, and the information you choose to provide to us when contacting us. To the extent permitted by applicable law, we may combine information collected, including information about the organization you work for, with other information either in our possession or that you provide to us.
The current personal data that Art Action absolutely needs for the purposes described below are indicated by an asterisk (*) on the various pages of the website. Without this mandatory data, Art Action will not be able to respond to your requests and/or provide you with the services requested.
Other personal data is purely optional and is intended to get to know you better and ultimately offer you better services and communications. During your visits to the website, we may use cookies, trackers and other similar techniques to collect information about how you use our Services and how we offer you certain features. The cookies used are used to automatically collect identifiers from your devices and other information about you, for example: Internet Protocol address (IP address), records and pages viewed. Purposes of processing

We collect and process your routine personal data with your consent and/or as necessary to perform a contract (e.g. to fulfill an order you have placed), comply with our legal obligations or meet our legitimate interests ( including for marketing purposes, to prevent fraud or to protect the security of our IT systems). We undertake not to process your current personal data in a way that would conflict with the purposes for which they were collected or subsequently authorized by you or not to collect information that is not mandatory for the purposes aforementioned. To the extent necessary, we will take all reasonable steps to ensure that the information is reliable for its intended use and that it is accurate, complete and up-to-date. We are also committed to collecting only common categories of data that are strictly required for the purposes indicated above.

Your rights

In accordance with applicable data protection laws and regulations, you have the right to obtain information and access to your personal data, to have it rectified or deleted, to limit its processing or to object to this processing, as well as the right to data portability to the extent applicable, unless Art Action can invoke a compelling legitimate reason to keep your current personal data. You can ask us at any time to stop sending you information about our offers, news and events by using the unsubscribe link at the bottom of each email we send you. In addition, you have the right to lodge a complaint with the competent local data protection authority (CCIN – Commission de Contrôle des Informations Nominatives) concerning activities which you believe infringe the protection of your rights in terms of personal data. Please note that we may, if necessary, ask you for additional information in order to better understand the reason for your request and prove your identity (example of providing an identity document), in order to ensure that your request does not infringe any right of third.

Data recipients

Your current personal data is processed by Art Action. They are neither transferred to third parties nor made accessible by them, except for the following persons: our service providers (e.g. hosting providers and maintenance service providers or advertising partners); in the event of a change of control, if we sell or otherwise transfer all or part of the company Art Action or our assets to another company (eg in the context of a transaction such as a merger, acquisition, liquidation); to third parties when this communication is required by a legal or regulatory provision or by a court decision, or when this disclosure is necessary to guarantee the protection and defense of rights or avoid possible damage.

Transfer of personal data and security measures

Art Action, its related companies or service providers may transfer information we collect about you to another country. If you live in the European Union, please note that we may transfer your personal information to a country that does not have the same data protection laws as those in your country. Any transfer outside the European Economic Area will only take place if appropriate safeguards are in place, i.e. equivalent level of security (e.g. standard contractual clauses and other safeguards). We use reasonable and appropriate security measures to maintain the information collected through our services and take appropriate steps to verify your identity before granting you access to your account.

Data retention

We will retain your current personal data for as long as your account remains active or as necessary to provide the services to you and only for as long as necessary for the processing purposes identified in this privacy statement. The information we receive about you may be retained for an extended period of time when it is subject to a legal obligation or an investigation or to avoid possible damage. Routine personal data that is used to send you information about Art Action offers, news and events is retained for a period of three (3) years from your last interaction with Art Action. Your current data will be destroyed within a maximum period of 30 days from any unsubscribe request from you.
The personal information that is collected and processed under the “Contact us” section and/or a similar section is only kept for the duration of the processing of your request. They are then deleted. Finally, connection records that are collected with your prior consent, through cookies, tracers and other similar tracking techniques that are implemented by our website, are kept in compliance with laws and regulations. applicable for a period not exceeding thirteen (13) months.
